Colorado Revised Statutes (CRS) Title 31, Article 11, outlines the procedures for Municipal Initiatives, Referenda, and Referred Measures, establishing how electors in Colorado cities and towns can propose laws (initiatives) or challenge existing ordinances (referenda) through petition processes, defining petition requirements, signature verification, ballot titles, and election processes, ensuring local democratic control over certain municipal decisions, (sources like Justia Law and FindLaw).

Key Aspects of CRS Title 31, Article 11:

  • Purpose: To safeguard and implement the powers of municipal electors to directly legislate on local matters, complementing state-level initiative powers.
  • Scope: Applies to initiatives (proposing new laws), referenda (challenging adopted ordinances), and referred measures (questions placed on the ballot by the legislative body) within municipalities.
  • Procedures: Covers the entire process, from petition formatting and circulation (Sections 31-11-106, 31-11-107) to signature verification (Section 31-11-109) and protests (Section 31-11-110).
  • Ballot Titles: Details how ballot titles are fixed to fairly represent the measure, avoiding confusion (Section 31-11-111).
  • Unlawful Acts: Prohibits actions like signing multiple times, signing with another's name, or tampering with petitions (Sections 31-11-114, 31-11-115).
  • Ordinance Referendum: Allows electors to petition against an ordinance within 30 days of its publication, preventing it from taking effect until validated (Section 31-11-105).
